General terms and conditions for trading via the CAMPERREICH® online shop for Switzerland and the Principality of Liechtenstein.
Scope
These General Terms and Conditions (hereinafter referred to as "GTC") apply to all contracts concluded by CAMPERREICH® / J.Ulmer Handels GmbH, HR number 1563536 , with persons or companies residing or domiciled in Switzerland or the Principality of Liechtenstein (hereinafter referred to as "Customer") for products (hereinafter referred to as "Products") offered in the CAMPERREICH® web shop (hereinafter referred to as "Web Shop"). By placing an order in the CAMPERREICH® web shop, the Customer accepts these GTC. Deliveries, services, offers, etc. from CAMPERREICH® via the web shop are made exclusively in accordance with these GTC. The GTC apply in the version current at the time the contract is concluded. CAMPERREICH® reserves the right to change these GTC at any time.
User account / customer information
The customer places orders via a user account or as a guest in the CAMPERREICH® online shop. All information provided by the customer in the user account and as a guest must be complete and true. Each customer may only open one user account.
Conclusion of contract and delivery
The contract between CAMPERREICH ® and the customer is only concluded upon express order confirmation or shipping confirmation from CAMPERREICH ® and is subject to the availability of the ordered products. The buyer remains bound to the order until the express order confirmation or shipping confirmation from CAMPERREICH ® . CAMPERREICH ® 's offer is primarily aimed at end consumers, which is why CAMPERREICH ® reserves the right not to fulfill or reject orders, particularly if quantities of products ordered are not in CAMPERREICH ® 's view customary for end consumers. The prices in Swiss francs, including VAT, valid on the order date and stated in the web shop apply to the products ordered by the buyer. Shipping costs are shown separately during the ordering process and in the order confirmation. CAMPERREICH ® only delivers to addresses within Switzerland or the Principality of Liechtenstein. The shipping method and type of packaging are determined by CAMPERREICH ® . Delivery dates and/or deadlines specified or communicated by CAMPERREICH ® are non-binding. If the delay exceeds twenty days or if delivery is impossible for more than twenty days, the customer and CAMPERREICH ® are entitled to withdraw from the contract without compensation.
Payment terms
All orders must be paid in Swiss francs, either by invoice or credit card. CAMPERREICH ® invoices are due within 30 days (without deductions). Starting with the third reminder, CAMPERREICH ® will charge a handling fee of CHF 40.00. For orders placed on account, CAMPERREICH ® is entitled to request advance payment without stating reasons (e.g., due to insufficient creditworthiness). When paying by invoice, ownership of the delivered goods is transferred to the customer only after full payment of the purchase price.
Testing, warranty and liability
The customer must immediately check the received shipments or products for accuracy, completeness, and freedom from defects. Any deviations from the order and any defects must be reported to CAMPERREICH ® in writing within 5 calendar days of delivery. Returns of defective products must be sent to CAMPERREICH ® . The shipment should be sent to the following address: CAMPERREICH ® , Karmaad 9, 9473 Gams, Switzerland. Packaging and shipping costs are borne by the customer. CAMPERREICH ® may, at its sole discretion, fulfill its warranty obligation through repair, replacement (with an identical or similar product), purchase price reduction, or refund of the purchase price. Other services, in particular compensation, are excluded in the event of a defect. By purchasing the products, the customer agrees to use them solely for their intended purpose. Any further liability of CAMPERREICH ® in connection with products or services provided by CAMPERREICH ® and its vicarious agents is excluded, to the extent permitted by law.
Data security and data protection
Data is transmitted via the internet. The internet is an open network accessible to everyone and is therefore generally not considered a secure environment. All payment transactions are processed according to the security standard applicable at the time of the transaction (https://). CAMPERREICH ® accepts no liability for the security of data during transmission via the internet. Personal data is processed in accordance with and in compliance with applicable data protection regulations for the purpose of contract execution and maintaining customer relations (including marketing measures). Customers' personal data is only passed on to third parties outside the CAMPERREICH ® Group to service partners involved in contract execution, such as the logistics company commissioned with the delivery. In such cases, the scope of the transmitted data is limited to the minimum necessary for contract execution. Customer data will not be passed on to third parties. The customer consents to the collection, processing, and use of their personal data in accordance with the aforementioned information. Furthermore, the terms and conditions for using the webshop website, which can be found under the Privacy Policy section, also apply to buyers.
Applicable law and place of jurisdiction
The contractual relationship, including these Terms and Conditions, is governed exclusively by Swiss law, excluding the conflict of law provisions of Swiss private international law, in particular excluding the United Nations Convention on Contracts for the International Sale of Goods (Vienna Sales Convention). The place of jurisdiction is Gams, Canton of St. Gallen, Switzerland. CAMPERREICH ® is also entitled to sue the customer at their general place of jurisdiction.
